Terms of Service

By accessing or using the Avtomarket mobile application ("App") and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

Avtomarket is an online marketplace that connects buyers and sellers of vehicles and automotive parts in the Balkans region. These Terms govern your use of the App as both a buyer and a seller.

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. By creating an account, you represent and warrant that you meet these requirements.

If you are using the Services on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials • All activities that occur under your account • Providing accurate and current information • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

When creating a listing, you agree that:

• All information provided is accurate, complete, and not misleading • You have the legal right to sell the listed item • Photos accurately represent the item being sold • Pricing is fair and honestly represented • You will not list stolen, illegal, or prohibited items

Avtomarket reserves the right to remove any listing that violates these Terms or applicable laws without prior notice.

Avtomarket serves as a platform connecting buyers and sellers. We are not a party to any transaction between users. Therefore:

• We do not guarantee the quality, safety, or legality of listed items • We do not guarantee that a transaction will be completed • Buyers and sellers are solely responsible for the terms of their transactions • We recommend meeting in safe, public locations for in-person transactions • Always verify vehicle documents and ownership before purchasing

Avtomarket offers free and paid listing packages:

• Basic (Free): Standard listing visibility for 30 days • Pro (Paid): Priority visibility, featured placement for 7 days, up to 15 photos, 60-day duration • Premium (Paid): Top visibility, featured placement for 30 days, up to 30 photos, 90-day duration

Featured listings may appear in highlighted areas of the app, including the home page, during the featured period.

Payments for listing packages are non-refundable once the listing is published. We may change pricing at any time with reasonable notice.

You agree not to:

• Post false, inaccurate, or misleading information • Engage in fraud, scams, or deceptive practices • Harass, threaten, or intimidate other users • Use the App for any unlawful purpose • Scrape, harvest, or collect user data without consent • Circumvent or manipulate our platform systems • Post spam, duplicate listings, or irrelevant content • Misrepresent your identity or affiliation

The Avtomarket name, logo, App design, and all related content are owned by Avtomarket and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Content you post (photos, descriptions) remains yours, but you grant Avtomarket a non-exclusive license to use, display, and distribute it within the App and for promotional purposes.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to our data practices as described in the Privacy Policy.

To the maximum extent permitted by law, Avtomarket shall not be liable for:

• Any indirect, incidental, or consequential damages • Loss of profits, data, or business opportunities • Damages arising from transactions between users • Service interruptions or technical failures • Third-party actions or content

Our total liability shall not exceed the amount you paid to Avtomarket in the 12 months preceding the claim.

Any disputes arising from these Terms or your use of the Services shall be resolved through:

1. Direct negotiation between the parties 2. Mediation through a mutually agreed mediator 3. If unresolved, binding arbitration under the laws of North Macedonia

For disputes between buyers and sellers, Avtomarket may assist with mediation but is under no obligation to do so.

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
